These Terms are governed by the laws of the Republic of South Africa, including but not limited to:

  • The Consumer Protection Act, 68 of 2008 (“CPA”)
  • The Electronic Communications and Transactions Act, 25 of 2002 (“ECTA”)
  • The Protection of Personal Information Act, 4 of 2013 (“POPIA”)

3. Eligibility and Customer Verification

By using this website, you confirm that:

  • You are at least 18 years old
  • You have the legal capacity to contract
  • You are authorised to purchase and use laboratory products

We reserve the right to:

  • Request FICA documentation or business credentials
  • Refuse or cancel orders where regulatory compliance cannot be verified

4. Product Use and Legal Restrictions

All products sold are intended strictly for professional, research, industrial, or educational use.

You agree to:

  • Handle, store, and dispose of chemicals in accordance with applicable laws
  • Maintain appropriate safety procedures and training
  • Not use products for unlawful, harmful, or prohibited purposes

We reserve the right to restrict or refuse supply of regulated or hazardous substances.

5. Hazardous Substances and Transport

Certain products may be classified as hazardous under South African law.

By purchasing such products, you acknowledge that:

  • You are aware of the risks associated with hazardous materials
  • You will comply with all safety, handling, and storage requirements
  • Delivery may be subject to special transport regulations

We may:

  • Delay or cancel shipments that do not meet compliance requirements
  • Require additional documentation before dispatch

6. Orders and Electronic Transactions (ECTA Compliance)

  • Orders placed online constitute an offer to purchase
  • Acceptance occurs when we confirm the order and/or dispatch goods
  • Electronic communications are considered received as per ECTA provisions

We reserve the right to cancel orders due to:

  • Stock unavailability

7. Pricing and Payment

  • All prices are in South African Rand (ZAR) and include VAT unless stated otherwise

  • Payment must be received in full prior to dispatch unless otherwise agreed

8. Delivery and Risk

  • Delivery is limited to South Africa unless otherwise agreed
  • Delivery timelines are estimates only
  • Risk passes to the customer upon delivery

Customers must ensure that:

  • Delivery locations are suitable for hazardous goods (if applicable)
  • Authorised personnel are available to receive shipments

9. Returns, Refunds, and CPA Rights

Nothing in these Terms limits your rights under the CPA.

9.1 Cooling-Off Period (ECTA)

Where applicable, consumers may cancel certain electronic transactions within 7 days without reason, subject to:

  • Products not being hazardous or opened
  • Compliance with return conditions

9.2 Defective Goods (CPA Section 56)

Customers are entitled to return defective goods within 6 months of delivery for:

  • Repair
  • Replacement
  • Refund

9.3 Non-Returnable Items

Due to safety and regulatory reasons, the following may not be returned:

  • Opened chemicals
  • Hazardous materials
  • Special-order items

10. Limitation of Liability

To the maximum extent permitted by law:

  • Products are supplied “as is”
  • Swift Chem is not liable for indirect, incidental, or consequential damages
  • Liability is limited to the purchase price of the product

Nothing in this clause limits liability where prohibited under the CPA.

11. Indemnity

You agree to indemnify Swift Chem against any claims, damages, or losses arising from:

  • Misuse of products
  • Failure to follow safety procedures
  • Breach of applicable laws or these Terms

12. Privacy and POPIA Compliance

We process personal information in accordance with POPIA.

By using our website, you consent to:

  • Collection of personal information necessary for order processing
  • Storage and processing of data used in order processing in a secure manner
  • Sharing information with logistics or regulatory authorities where required

You have the right to:

  • Access your personal data
  • Request correction or deletion
  • Object to certain processing activities
