1. Purpose

This Chemical Handling and Safety Disclaimer forms part of Swift Chem’s Terms and Conditions and applies to all products supplied by Swift Chem.

Many products supplied by Swift Chem are hazardous substances and must be handled, stored, transported, used, and disposed of responsibly and in accordance with applicable laws and industry standards.

By purchasing or using products supplied by Swift Chem, you acknowledge and agree to the terms of this disclaimer.

 

2. Intended Users

2.1 Products supplied by Swift Chem are intended for use by suitably trained, qualified, and competent persons who possess the necessary knowledge, experience, equipment, and facilities to safely handle such products.

2.2 Customers are responsible for ensuring that all persons who handle, store, transport, or use the products are appropriately trained and informed regarding the associated hazards.

 

3. Safety Data Sheets (SDS)

3.1 Safety Data Sheets (“SDS”) and product safety information are available for applicable products.

3.2 Customers must review the applicable SDS and all product labels before handling, storing, transporting, or using any product.

3.3 Failure to follow SDS instructions may result in serious injury, illness, environmental harm, property damage, or death.

 

4. Product Labelling

4.1 Products supplied by Swift Chem will, where applicable, be labelled in accordance with relevant South African legislation and standards, including the Globally Harmonised System of Classification and Labelling of Chemicals (GHS) as adopted in South Africa.

4.2 Customers must not remove, obscure, alter, or deface product labels, hazard warnings, or safety information.

 

5. Safe Handling, Storage and Disposal

5.1 Customers are solely responsible for the safe handling, storage, transportation, use, and disposal of all products after delivery.

5.2 Products must be stored in accordance with the applicable SDS, product instructions, manufacturer recommendations, and legal requirements.

5.3 Customers must ensure that hazardous substances are secured against unauthorised access and are stored separately from incompatible materials.

5.4 Disposal of chemicals, contaminated containers, and waste products must be conducted in accordance with all applicable environmental and waste management legislation.

 

6. Compliance with Applicable Laws

Customers are responsible for ensuring compliance with all applicable laws, regulations, permits, standards, and codes of practice, including but not limited to:

  • The Occupational Health and Safety Act, 85 of 1993;

  • The Hazardous Chemical Agents Regulations;

  • Environmental and waste management legislation;

  • Transportation and storage requirements relating to hazardous substances; and

  • Any other applicable regulatory requirements.

 

7. Suitability of Products

7.1 Unless expressly agreed in writing, Swift Chem does not warrant that any product is suitable for a customer’s specific application, process, experiment, manufacturing activity, or intended use.

7.2 Customers are responsible for determining whether a product is appropriate for their intended purpose.

 

8. Limitation of Liability

8.1 To the fullest extent permitted by law, Swift Chem shall not be liable for any injury, illness, death, property damage, environmental damage, loss, expense, or consequential loss arising from:

  • Improper handling, storage, transportation, use, or disposal of products;

  • Failure to follow SDS instructions, warnings, or product labels;

  • Use of products by untrained or unauthorised persons;

  • Modification, mixing, dilution, or repackaging of products after delivery; or

  • Any use of products contrary to applicable laws or industry standards.

8.2 Nothing in this disclaimer excludes, restricts, or limits any liability that cannot lawfully be excluded or limited under South African law, including rights afforded to consumers under the Consumer Protection Act.
