Refund and Returns Policy
1. Your Legal Rights
This Returns and Refunds Policy is intended to comply with the Consumer Protection Act, 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act, 25 of 2002 (“ECT Act”), and other applicable South African consumer protection laws.
Nothing in this policy limits or excludes any rights that consumers may have under applicable law.
2. Seven-Day Cooling-Off Right for Online Purchases
2.1 In accordance with section 44 of the ECT Act, consumers may cancel an online purchase without reason within seven (7) days after receiving the goods.
2.2 To exercise this right, you must notify Swift Chem in writing within the seven-day period.
2.3 You will be responsible for the direct costs of returning the goods unless otherwise required by law.
2.4 Returned goods must, where reasonably possible, be returned unused, in their original packaging, and in the same condition in which they were delivered.
2.5 Upon receipt of the returned goods, Swift Chem will process the applicable refund in accordance with the ECT Act.
3. Goods Damaged, Incorrectly Supplied or Not as Ordered
3.1 You should inspect all goods upon delivery.
3.2 If goods are damaged during transit, incorrectly supplied, incomplete, or materially different from your order, please notify Swift Chem as soon as reasonably possible and no later than seven (7) days after delivery.
3.3 Where goods have been incorrectly supplied, damaged before delivery, or do not correspond with your order, Swift Chem will arrange collection, replacement, repair, or refund as required by law and at no additional cost to you.
4. Implied Warranty of Quality
4.1 In terms of section 56 of the CPA, all goods sold by Swift Chem are subject to an implied warranty of quality for six (6) months from the date of delivery.
4.2 If any goods fail to satisfy the requirements of section 55 of the CPA, you may return the goods within six (6) months of delivery and elect to receive a repair, replacement, or refund, subject to the provisions of the CPA.
4.3 This warranty does not apply where goods have been misused, improperly stored, negligently handled, altered, contaminated, or used contrary to instructions provided by Swift Chem or the manufacturer.
5. Non-Returnable Goods
Subject to applicable consumer protection laws, the following goods may not be returned for reasons other than defect, damage, or incorrect supply:

Custom-made or specially manufactured products;

Custom chemical formulations;

Hazardous chemicals and regulated substances;

Perishable reagents and products with limited shelf life;

Temperature-sensitive products;
-
Goods supplied in sealed containers where the seal has been broken;

Opened, partially used, contaminated, or tampered-with products;
-
Goods that cannot safely be resold due to health, safety, quality control, or regulatory requirements.
Nothing in this clause limits your rights under the CPA in respect of defective, unsafe, or incorrectly supplied goods.
6. Refunds
6.1 Approved refunds will be processed using the original payment method wherever reasonably possible.
6.2 Refunds will be processed within a reasonable period after inspection and approval of the returned goods and, where applicable, within the time periods prescribed by law.
6.3 Shipping charges are non-refundable unless the return arises from defective goods, incorrect supply, or another circumstance for which Swift Chem is legally responsible.
7. Return Procedure
7.1 To request a return, refund, repair, or replacement, please contact Swift Chem at info@swiftchem.co.za.
7.2 Please include:

Your order number;

A description of the issue;

Photographs of the goods where applicable; and
-
Any other information reasonably required to assess the return request.
7.3 No chemicals or hazardous products may be returned without prior written authorisation from Swift Chem.
